Failing Fr. Bernas' Consti class and Atty. Vallente's Crim class meant bye bye Ateneo. Law school is in a waaay different league. There is absolutely no room for mediocrity. First time to have failed in school ever, and I failed two subjects! :D I cut my hair, ate a tub of ice cream, and bought a pair of shoes then. I filled out appeal forms and sent letters and spent the next 6 months waiting. At home, out running errands, or otherwise being monitored by Noel with a blow-by-blow account of where I went when I get home. I wasn't allowed to get a job because dad thought I would lose my drive.

I met Dean Ulan (a.k.a. King Mufasa) in Boracay over the summer though. :) He convinced me to transfer to his kingdom--San Beda Alabang. Despite my pending appeals, I went over and enrolled. The units I earned from Ateneo were creditted, but because of the disparity of credit units allocated on a J.D. program and an Ll.B., I had to repeat some.

I earned 3 units of Persons and Family Relations Law back in college for my pre-law degree. I earned 4 units under Atty Mel Sta. Maria back in Ateneo. And then I had to earn 5 units of the same course again even if I've already passed it twice. :D I think I would've been suicidal if I failed it and had to take it a fourth time, but thanks to the lovely Atty Bruce, I got an 85. :)

I failed Crim and Consti so I naturally had to re-take them. Having Atty Amurao for Crim scared me shitless especially when I found out that only one student passed in last year's class, but luckily, he chose to pass five of us this year. :) (I guess I have Atty Vallente to thank for that. :)) I had my old Legal Research prof for Consti. Chewy gave me an 87 back in Ateneo. He gave me an 87 again this year, hahahaha. What are the odds of that. :)

I know I haven't checked the results of my last pending appeal yet, but it doesn't matter anymore. With the release of my grades from the first semester I spent in San Beda, I feel like I definitely definitely got my closure. :)

I cut my hair again last week.
Damn. I'd have a whole year of I-miss-my-long-hair woes again.

I skipped a one-unit class tonite where we do nothing but talk about yesterday's gospel for a half-hour and idk, Santo Niño the next, and did a lot of nothing that may or may not include keeling over in pain, wrapping myself in a blanket like a hobo, and running quite a temperature▬▬all in the natural course (and astonishing feat) of non-hemophiliac bleeding for days without dying.

On another note, I've finally fiddled with the twitter account I've set up some time ago so I could follow Dr. Horrible's tweets. :D (Act IV now, pretty please?)

FACTS:

- Soledad Escritor, a court interpreter in a Regional Trial Court, has been living with Quilapio (a man not her husband) for 20 years and had borne a child with this live-in arrangement.

- At the instance of complainant Alejandro Estrada, respondent was charged with committing “disgraceful and immoral conduct” under the Revised Administrative Code.

- Escritor asserted that as a member of the religious sect known as Jehovah’s Witnesses, and having jointly executed a “Declaration of Pledging Faithfulness” (which allows members of the congregation who have been abandoned by their spouses to enter into marital relations) with Quilapio after ten years of living together, her conjugal arrangement is in conformity with her religious beliefs and has the approval of the congregation, therefore not constituting disgraceful and immoral conduct.

- Prior to Escritor and Quilapio’s conjugal arrangement, Escritor’s husband left her for another woman. In 1998, this husband died. Escritor then entered the judiciary in 1999.

- The Court held that benevolent neutrality and accommodation is the spirit underlying the religious clause in the Constitution and that in deciding respondent’s plea of exemption based on the Free Exercise Clause, it is the compelling state interest test which must be applied.

- The Court then remanded the complaint to the Office of the Court Administrator and ordered the Office of the Solicitor General to intervene, thereafter leaving the Court the task to determine whether the evidence adduced by the State proves its more compelling interest.

ISSUE:

- Whether or not Soledad is administratively liable for disgraceful and immoral conduct, (i.e. living in with Quilapio)

HELD:

- NO

RATIO:

- The Constitution adheres to the benevolent neutrality approach that gives room for accommodation of religious exercises as required by the Free Exercise Clause, provided that it does not offend compelling state interests.

- The OSG must then demonstrate that the state has used the least intrusive means possible so that the free exercise clause is not infringed any more than necessary to achieve the legitimate goal of the state. In this case, with no iota of evidence offered, the records are bereft of even a feeble attempt to show that the state adopted the least intrusive means.

- With the Solicitor General utterly failing to prove this element of the test, and under these distinct circumstances, Escritor cannot be penalized.

- The Constitution itself mandates the Court to make exemptions in cases involving criminal laws of general application, and under these distinct circumstances, such conjugal arrangement cannot be penalized for there is a case for exemption from the law based on the fundamental right to freedom of religion.

- In the area of religious exercise as a preferred freedom, man stands accountable to an authority higher than the state.

He's made one ceremonious stroke on my card for three consecutive times, and I hope I'm not pushing my luck too much when I wish for it to happen a fourth time. :)

No other way but the socratic method, of course, but this one's particularly sinister. He's got this 3-second rule where he marks your card with a "60" and calls the next person when you don't come up with the answer right away.

I've thought of cheating by rambling "My family... my family... OMIGOD" to buy myself time while his brain cells yelp trying to comprehend what just happened, but thankfully, I haven't found a need to try this desperate measure yet. ;)

I save my moneyz by reading the text online thru supremecourt.gov.ph and lawphil.net, but making case digests and identifying relevant issues are so much easier when I have the syllabi from photocopied SCRA pages. :(

Medyo boring. :D

I'd rather practice Family Law, or HR and PIL. :)

Come to think of it, back in college, the major law subject I got the highest marks on was for Family Law. :) I know I studied my ass off because Atty. Santiago scares the shit out of me (Danica, if you ever come across this, I miss you! :)), but I was genuinely interested. :) Haha. I even have it on my interests list since forever. :D ~~Even on friendster! (Oh dear abandoned dinosaur accounts :D)~~ I chose to have my internship in that Senate committee because of that too. :) (Actually, apatots's association prompted me to write about this. :D I'm not done with the lollerskates.)

Hay. I sometimes worry if I like something because I want it for myself, or I just learned to like it because dad makes it shiny. :D But I guess no matter how much he limits options and try to run my life, I'd still decide what I feel like doing. :DD

I was reading Sis Meg Gutierrez's crack clarification post ♥, and it seems like one of my seniors at the law school, Margarita Gutierrez, is on the running for this years Binibinig Pilipinas Pageant. (I think I've watched one too many ANTM.)

In Ateneo Law, incoming students had to attend ~~a boot camp~~ Intro to Law classes ~~in the dungeon~~ at the basement AVR for a week as a whole group, conducted by Atty. Judd Roy. I never blogged about it before, but it was nerve-wracking as fuck.

Three days before the week-long 5-hour/day sessions started, Dean Roy releases the case list--a GINORMOUS collection of basic local and foreign jurisprudence we'd have to know by heart, recite on, and make case digests of.

We had the option to either pick up copies at the Rockwell campus, or just print from softcopies sent. I opted for the latter, so I was absolutely panicking and loopy when the on the morning of the first session (call time at 8!), our class beadle's email which reads, "There are two additional readings, entitled "El Poder" and some readings in Public International Law. These were not given to us." remained as is.

I'm pretty sure all 200(+/-) of us would mentally/physically cross our fingers every time Dean Roy booms out, "I NEED A FRIEND." and all of us would be waiting with bathed breath and stare at Dean Roy's "angels" with pleading eyes while they randomly pick a name from the list.

Ah, the legendary Judd Roy Angels. :D
Every year, (this might sound pervy :D) he handpicks four lovely women from the upper classes to help him manage all 200 Intro-to-Law attendees, and Marge was one of them. :3 I hope she wins. :)
